Common High-Value Marital Assets

During a divorce, your marital assets will be assessed and distributed between you and your spouse. High net worth couples typically have valuable assets that may be vigorously contested during the property division process, such as:

  • Home and additional properties (vacation homes, rental properties)
  • High-end vehicles
  • Boats
  • Furnishings
  • Jewelry
  • Art collections
  • Financial accounts
  • Investments
  • Retirement accounts
  • Businesses or professional practices
  • Commercial property
  • Land

These types of assets may need to be valued by experts before they can be divided. We have a network of trusted valuation experts.

Do you think your spouse might be hiding assets from you? This is a potential concern in a high net worth divorce. If you suspect that your spouse is hiding assets, we will work with forensic accountants and other investigators to find them.

The Division Of Property And Debts In Georgia

When it comes to divorce, Georgia is an equitable division state. Because of this, the marital assets and debts are divided equitably (fairly) instead of by a 50/50 division. Any assets or property owned by one party before the marriage are considered separate property and will not be divided during the divorce. Property that is acquired during the marriage is considered marital property, unless it is specified in a pre- or postnuptial agreement, or it was a gift or an inheritance for one of the parties.

Marital debts must also be divided between the parties. Some of the most common types of marital debt are mortgages, vehicle loans, business loans and credit card bills.

Frequently Asked Questions About High-Asset Divorce In Georgia

Below, our family law attorneys answer some of the most common questions asked about high-asset divorce in Georgia.

How can my separate property become marital property through commingling?

Separate property can lose its protection if it is mixed with marital funds in a way that makes it difficult to distinguish its original source. Examples include:

  • Depositing a separate inheritance into a joint marital account
  • Covering expenses for a separate premarital asset with marital funds
  • Paying the mortgage on a home owned before marriage with marital funds

Georgia courts evaluate the intent of the spouses and the extent to which the funds or assets have been blended. When the mixing is substantial, the court may determine that the property has become marital and is therefore subject to equitable division.

Maintaining clear financial records and tracing the origin of funds is essential to preserving the separate nature of high-value assets during a divorce.

What is the difference between personal goodwill and enterprise goodwill in business valuation?

When a business or professional practice is part of the marital estate, Georgia courts distinguish between two forms of goodwill to determine what is subject to division.

  • Enterprise goodwill reflects the value of the business as an independent entity, including its systems, brand recognition and customer base. This type of goodwill is considered a marital asset.
  • Personal goodwill is tied to the individual owner’s reputation, skills and personal relationships. Since it depends on the specific person rather than the business itself, it is generally treated as separate property.

Separating these categories is crucial to avoid inflating the value of the business and help ensure that the owner is not unfairly burdened during asset distribution.

Can we keep our financial disclosures and business details private during the divorce?

Most divorce filings become part of the public record, which can be a significant concern for business owners and individuals with sensitive financial portfolios. Privacy can be better protected by using alternative dispute resolution methods such as private mediation, where financial documents are not filed with the court.

Additionally, our attorneys can request protective orders or ask the court to seal specific documents. This can help prevent proprietary business information or personal financial data from becoming publicly accessible. We prioritize solutions that help safeguard both confidentiality and professional reputation throughout the high-asset divorce process.
